1. Applicability
These Terms and Conditions (“Terms”) govern your access to and use of the form builder platform provided at https://bildby.com (“Bildby”, “we”, “us”, “our”). The Service is owned and operated by Bildby.
By creating an account or using any part of the Service, you (“User”, “you”) agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service. 2. Definitions
Account: the user account created to access the Service.
Agreement: these Terms and all referenced policies.
Form Data: responses, files, uploads, and data collected via the Service.
User Content: forms, text, images, configurations, or materials submitted by the User.
Paid Plan: PRO or any paid subscription tier.
Tool / Service: the form builder platform provided by Bildby.
3. Description of the Service
Bildby provides an online platform for creating and managing forms, collecting responses, and uploading files.
Access to the Service requires creating an Account.
No part of the Tool is accessible without an Account.Certain features require a Paid Plan.
We may improve, add, modify, restrict, or discontinue features at any time.
4. Use of the Service
You agree to:
1. comply with all applicable laws (including data protection laws);
2. refrain from uploading unlawful, infringing, harmful, obscene, or deceptive content;
3. refrain from transmitting malware, harmful code, or automated scraping;
4. avoid interfering with or disrupting the Service.
You are solely responsible for:
1. your internet connection and device setup;
2. maintaining control of your email inbox for OTP authentication;
3. all data and content submitted through the Service.
We are not liable for damages resulting from your failure to comply with these requirements.
5. License & Limitations
Bildby grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Service during the Agreement.
You may not:
1. reverse engineer, decompile, or extract source code;
2. copy, distribute, or sell any part of the Service;
3. remove proprietary notices;
4. create derivative works based on the Service;
5. use the Service for illegal, harmful, or competitive purposes;
6. circumvent access or usage limits;
7. use automated tools to scrape or overload the system.
6. Accounts & OTP Authentication
You must create an Account to use the Service and provide accurate information. Bildby uses passwordless authentication via one-time login codes (OTP) sent to your email. You are responsible for:
1. maintaining access to your email inbox;
2. ensuring that OTPs remain confidential;
3. notifying us immediately of unauthorized access.
We may suspend or terminate your Account if you violate these Terms.
7. User Content & Form Data
7.1 Ownership
You retain ownership of your User Content and Form Data.
7.2 License to Bildby
You grant Bildby a limited license to host, process, and transmit User Content solely to operate the Service.
7.3 Compliance Responsibilities
You are solely responsible for:
1. obtaining consent from respondents;
2. complying with privacy and data protection laws;
3. ensuring you are legally permitted to collect the data you collect.
7.4 Backups
Bildby is not a long-term data storage provider. You must export and back up your data regularly. Data may be deleted after Account termination or where operationally necessary
8. Usage Limits
Certain features of the Service are subject to usage limits based on your selected plan (such as the number of responses, file uploads, storage, and form submissions allowed per billing cycle). These limits are displayed on our pricing page.
Bildby may:
1. Enforce hard limits to prevent usage beyond your plan’s allocation;
2. Temporarily restrict access to features when limits are reached;
3. Require upgrading to a higher plan to continue usage beyond the included limits.
Users who attempt to bypass or manipulate these limits may have their Accounts suspended or terminated.
9. Payments, Billing & Taxes
9.1 Billing
Features require a subscription. Pricing is displayed on our website.
9.2 Payment Processing via Paddle
All payments are handled by Paddle, our billing partner and Merchant of Record.
Paddle:
1. processes payments securely,
2. may apply VAT, GST, or other taxes based on your location,
3. issues invoices and manages compliance.
By subscribing, you authorize Paddle to charge your selected payment method.
9.3 Failed Payments
If payment fails, your access may be suspended until payment is completed.
9.4 Price Changes
We may adjust pricing with at least 30 days’ notice. Continued use after the effective date constitutes acceptance.
9.5 Refunds
All payments for Bildby subscriptions are processed by
Paddle.com.
Refunds may be issued by Paddle at their sole discretion and in accordance with Paddle’s Buyer Protection & Refund Policy:

support@bildby.com, and we will assist you in submitting your request.
Refunds may be refused in cases of fraud, refund abuse, or manipulative behavior.
Subscription cancellations stop future renewals. Your current billing period remains active until it ends, and no refunds are provided for unused time.
Our order process is conducted by Paddle.com, the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
9.6 14-Day Withdrawal Period (EU/UK Consumers Only)
If you are an EU or UK consumer, you may have the legal right to withdraw from your purchase within 14 days of the transaction date. However, by creating an account, accessing the Service, or using any paid feature before the end of the 14-day period, you acknowledge that the Service is provided immediately and you waive your right to withdraw under applicable consumer laws.
Refunds within or after this period may still be issued at the discretion of Paddle.com, in accordance with their Buyer Protection & Refund Policy.
9.7 Usage LimitsUsage limits are reset every billing cycle. Exceeding your plan’s allocation may require upgrading to a higher plan.
10. Intellectual Property Rights
The Service, UI, software, design, branding, and all underlying intellectual property remain Bildby’s exclusive property.
No rights are granted except those explicitly stated in these Terms.
Feedback
If you provide feedback, ideas, or suggestions, Bildby may use them freely without obligation or compensation.
11. Privacy & Data Protection
We process personal data in accordance with our Privacy Policy. By using the Service, you consent to such processing.
12. Availability & Maintenance
We strive to provide reliable and continuous access.
However, disruptions may occur due to:
1. maintenance,
2. updates,
3. third-party services (e.g., cloud infrastructure, email providers),
4. network failures,
5. circumstances beyond our control.
We do not guarantee uninterrupted uptime.
13. Liability
To the maximum extent permitted by law, Bildby is not liable for:
1. indirect, incidental, or consequential damages;
2. service interruptions or downtimes;
3. data loss;
4. third-party services or integrations;
5. unauthorized access to your Account;
6. errors caused by you or your configuration.
Our total liability for any claim is limited to:the fees you paid in the 3 months prior to the event, or USD 100, whichever is higher.
14. Warranties
The Service is provided “as is” and “as available”, without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, or non-infringement.
15. Indemnification
15.1 Indemnification by User
You agree to indemnify, defend, and hold Bildby harmless from any claims, liabilities, losses, or damages arising from:
1. your violation of these Terms;
2. your User Content or Form Data;
3. your misuse of the Service;
4. violation of third-party rights;
5. violations of data protection or consumer laws.
15.2 Intellectual Property Indemnity
You further indemnify Bildby from claims related to:
1. copying, reproducing, or distributing any part of the Service;
2. reverse engineering or extracting source code;
3. creating derivative works;
4. using Bildby branding or UI without permission;
5. any infringement of Bildby’s IP rights.
Bildby may take legal action to protect its intellectual property.
15.3 Indemnification by Bildby
Bildby will indemnify you against substantiated third-party claims alleging that the unmodified Service infringes third-party intellectual property rights.This indemnity does not apply if the claim arises from:
1. your modifications;
2. your misuse;
3. your combination of Bildby with external software;
4. your violation of these Terms.
16. Termination
You may cancel your Account at any time.
For Paid Plans, cancellation takes effect at the end of the current billing cycle.
Bildby may suspend or terminate your Account immediately if you:
1. Violate these Terms;
2. Violate usage limits intentionally;
3. Engage in illegal or unsafe activities;
4. Pose security or operational risks.
Upon termination, access to the Service ends and data may be deleted.
17. Modifications to Terms
We may update these Terms periodically.
Significant changes will be announced with reasonable notice.
Continued use after updates constitutes acceptance.
18. Miscellaneous
1. No waiver: failing to enforce a right does not waive it.
2. Severability: invalid provisions are replaced with enforceable ones closest in intent.
3. Entire Agreement: these Terms supersede all prior agreements.
4. Assignment: you may not assign rights; Bildby may assign these Terms.
19. Governing Law & Jurisdiction
These Terms are governed by the laws of Singapore. Disputes must be brought exclusively before the Singapore courts,
subject to any mandatory consumer protection rights applicable to you under your local laws.
